
Melissa has practiced in the employee benefits and ERISA area for over 25 years. She advises clients in the design and implementation of employee benefits plans and assists employers and their advisors with both retirement and welfare benefit plans issues, equity compensation matters, and IRC Section 409A compliance.
Her benefits practice includes assisting clients with their plans at all stages of a company's development, from the early stages of implementing a program, to advising on established plans, and to consolidating or terminating plans. She provides counsel and support in the implementation of employee benefit programs including retirement plans and welfare benefit plans such as health, life, accident and disability plans, cafeteria and flexible benefit plans and employee compensation issues, as well as with the administration and documentation of those benefit plans. Melissa's practice includes the preparation and review of plan documents, summary plan descriptions and administrative materials, the preparation of IRS determination letter requests and voluntary compliance filings for qualified retirement plans, and the handling of employee benefits issues in business transactions. She is also able to advise on best practices in the benefits area and can assist employers with resolution of issues when problems arise in the benefits area.
Melissa has considerable experience assisting clients in the design, implementation and administration of non-qualified deferred compensation plans, including stock option and restricted stock plans, and compliance with Section 409A of the Internal Revenue Code.
Having practiced as both outside counsel and in-house attorney with PCS Phosphate Company in Raleigh, Melissa has a unique understanding of the needs of business owners regarding their benefit plans.
An active community volunteer, Melissa has served on the Board and as President of the Cardinal Chapter of the National Charity League, Inc. and volunteers at Saint Mary's School and with her children's athletic teams. She is a frequent speaker on employee benefits issues.
