Construction

Brooks Pierce attorneys represent all segments of the construction industry, including numerous governmental entities, such as the State of North Carolina, numerous cities (including the City of Greensboro), counties, and governmental subdivisions, authorities, and school boards. We also represent large, international corporate clients and construction firms as well as numerous contractors, construction managers, subcontractors, and design professionals. Because of our broad experience with all aspects of the construction industry, we understand the perspective of all parties to a construction dispute and can identify issues important to all parties both at the planning stage and in designing strategies for prompt and economic resolution of disputes. Our construction law practice involves not only the handling of matters in North Carolina's federal, state and administrative courts, but also in the United States Court of Federal Claims and state and federal courts located in other states throughout the country. We have been involved in the resolution of construction disputes through arbitration, mediation and various alternative dispute resolution proceedings.

Because we have in many instances represented our construction clients for many years, our strategy is first to help our clients avoid disputes and claims by pro-active involvement to implement contract and administration procedures to avoid disputes. If construction-related disputes do arise, our strategy is to use our extensive experience and insight to promptly identify the issues of critical importance to our client and then to devise appropriate strategies to expeditiously achieve favorable results in the most cost effective manner. Our firm has been involved not only in mediation, but in practically every type of alternative dispute resolution proceedings. This familiarization helps us to identify and implement the type of alternative dispute resolution proceeding most likely to achieve success for our clients. Because of our depth of personnel and construction experience, we are able to handle disputes of any size. We have the experience to and have handled $100 million claims involving delay and impact analysis, and complicated technical issues. We routinely manage teams of experts as needed for scheduling, impact, productivity, damages and financial analysis, geological and subsurface conditions, and architectural and engineering issues. No matter what the size of the case, we have the depth and experience to bring in experienced lawyers and support personnel, from first chair to paralegal and document support.

Many of our lawyers are members of the American Bar Association Forum on the Construction Industry, the North Carolina Bar Association's Construction Law Section and serve or have served its governing body, the North Carolina Construction Law Section Council. Also, our attorneys are frequent speakers at seminars, continuing legal education programs, and construction industry meetings.
