Professional Liability Litigation

In recent years, Brooks Pierce has successfully represented major law firms and accounting firms in professional liability litigation, ethics proceedings, and governmental investigations. Such proceedings include complex corporate transactions, securities offerings and disclosures, and auditing, litigation, and tax issues which have resulted in claims of fraud, negligence, negligent misrepresentation, breach of fiduciary duty, conspiracy, unfair trade practices, and securities violations.

Because of our substantial experience representing accounting firms, our attorneys are able to quickly understand and effectively communicate with others concerning complex accounting pronouncements, rules and concepts. We have successfully tried major cases for our accounting firm clients. We also have obtained positive results for professional firms short of trial, both through successful motions filed in some of these lawsuits and through careful judgment and guidance in the settlement process in others. These successfully resolved cases have included claims of negligence, negligent misrepresentation, securities fraud, breach of fiduciary duty, conspiracy and aiding and abetting on both the assurance side of the accounting practice (audits and reviews) and the tax side of the practice.
