Brooks Pierce partner Thomas Varnum was quoted in a Super Lawyers article on copyright infringement and fair use. The article was published Dec. 14.

The article, “What is Fair Use, Anyway?” discusses some common misconceptions of the fair use exception and the four factors that determine whether fair use applies.

Varnum mentions the steps a copyright holder should take to respond to unauthorized use of a protected work, if not considered fair use, can vary depending on where it’s being used.

“If it’s on a website that allows users to upload their own content, copyright holders may be able to leverage the Digital Millennium Copyright Act (DMCA) to have the platform remove the content,” he said.
