Mike Dowling Speaks on Technological Surveillance at Digital Evidence Series


Brooks Pierce attorney Mike Dowling recently spoke at Part II of the Digital Evidence Series, sponsored by the North Carolina Office of Indigent Defense Services, on Friday, Jan. 12. The presentation, which took place at the Alamance County Civil Courthouse, was part of a broader educational series designed to enhance the knowledge of criminal defense attorneys and investigators.

Dowling’s presentation, “Identifying & Challenging Technological Surveillance,” authored by fellow attorney Elliot Abrams, addressed the legal challenges to cell phone location information and other cutting-edge surveillance techniques. The presentation covered law enforcement use of cell tower location information and stingray devices, precision GPS tracking and other similar investigative tools, as well as the government’s techniques for masking its use of such technologies. Dowling presented insight and advice on how to analyze discovery to determine when a stingray or other sensitive surveillance technology has been used in a criminal investigation. He also discussed strategies for litigating cases where stingray devices or other cell phone location techniques were used.

Dowling focuses his practice on general commercial litigation and federal criminal defense. He has considerable experience with a wide array of federal criminal matters, including those involving multi-defendant drug conspiracies, firearms violations, immigration fraud, mail fraud, wire fraud and other white-collar criminal matters. He also has experience with complex pre-trial motions involving the use of electronic and technical evidence and digital media. Dowling has been recognized for his work in North Carolina Super Lawyers and in Business North Carolina’s “Legal Elite.”
