Brooks Pierce partner Eric David was quoted in a Feb. 14 Reuters article on the dismissal of former vice presidential candidate Sarah Palin's defamation lawsuit against the New York Times.

The article, “Judge to dismiss Sarah Palin case against N. Y. Times regardless of jury verdict,” discusses U.S. District Judge Jed Rakoff’s decision to dismiss Palin’s lawsuit “because she failed to show the Times acted with ‘actual malice,’ the standard in lawsuits involving public figures.” The article also analyzes the potential impact of this decision.

In the article, David said, “a jury verdict favoring the Times would be ‘much more appeal-proof’ because appeals courts are reluctant to second-guess jurors' factual determinations.”

David focuses his practice on business litigation, constitutional litigation, and media and communications law. He has advocated on behalf of publisher and broadcast clients in various First Amendment and newsgathering matters, including disputes over the North Carolina Public Records Act and access to public meetings. David has substantial experience defending both large and small publishers against defamation claims in state and federal court.
