Brooks Pierce attorney Ryan Fairchild recently talked with Law.com’s Legaltech News about esports players’ rights.

The article, entitled “As Esports Take Off, Questions Abound over Players’ Rights of Publicity,” details the arising intellectual property issues within the industry.

Fairchild explains that the lack of a governing body in the industry provides publishers with the opportunity to control more of players’ rights.

“They try to capture more player rights in terms of likeness and image so that they can market against those. Since those rights are getting captured, players don’t have a lot of opportunity to go and pursue sponsorships,” Fairchild said.
